Privacy

The Department of the Treasury (the department) administers the Franchise Disclosure Register (the Register). The department is bound by the Australian Privacy Principles outlined in Schedule 1 of the Privacy Act 1988 (Cth), which regulates how we may collect, use, disclose and store personal information.

Franchisor and/or their authorised agent’s access to the Register is facilitated through the Digital Identity Exchange. Your name will be collected by the department to verify your identity and authority to provide information and, or upload documents on the Register on behalf of the franchisor.

As part of the process of uploading documents and information for publication on the Register, the department may collect personal information to support the administration and enforcement of the Competition and Consumer (Industry Codes – Franchising) Regulation 2014 (Franchising Code), for the purpose of creating your franchisor user profile and for inclusion in the franchisor’s public profile on the Register. If you do not provide the information (including personal information) requested in the create your profile form, you will not be able to create your profile.

By providing your personal information (e.g. email, phone number and work address) you consent to the department publishing your contact details on the Register. Failure to provide information (including personal information) required by the Franchising Code to be published on the Register is subject to a civil penalty of up to 600 penalty units.

Personal information including your name, job title or position, work contact details (e.g. email, phone number and work address) may be published on the Register to allow interested parties or prospective franchisees to contact you. Your personal information may also be used by departmental staff who are involved in the administration of the Register to contact you regarding your profile, disclosure documents and/or to seek further information for research and evaluation purposes. Your personal information may be disclosed to the Australian Competition and Consumer Commission to support the administration and enforcement of the Franchising Code and/or the Competition and Consumer Act 2010 (Cth).
